Terms of Service
Last updated: 16 October 2026
1. Who these terms are between
These terms are a contract between you (the business or person using SplashSend) and CKR Digital Limited, trading as SplashSend, a company registered in England and Wales (company number 17290887) whose registered office is 135 High Street, Needham Market, Suffolk, IP6 8DH. By creating an account or using the service you agree to them, together with our Privacy Policy and, where you upload other people's details, our Data Processing Agreement, which forms part of these terms. SplashSend is a service for businesses; if you use it on behalf of a company you confirm you are able to bind it.
2. Your account
Keep your sign-in details safe. Everything done under your account is your responsibility, and you must tell us straight away if you think someone else has got in. You must be 16 or over.
3. What you may not do
You must have permission to email everyone on your list. That means you may not:
- upload or send to purchased, rented, scraped or otherwise acquired lists of people who did not ask to hear from you;
- send anything unlawful, deceptive, misleading or harassing, or that infringes someone else's rights;
- send malware or phishing, or content that is sexually explicit or that promotes violence or hatred;
- misrepresent who you are in the sender name, address or subject line;
- remove or break the unsubscribe link in an email, or leave out your postal address where the law requires it;
- interfere with the service or other customers, or try to get around plan limits or sending checks;
- send through several accounts or domains to spread out bounces or complaints, or run a list through SplashSend to clean it before sending it elsewhere;
- collect people's details without their knowledge, for example by scraping websites or social media.
Every email sent through SplashSend must comply with the laws that apply to you and your recipients, including UK GDPR and PECR, the EU GDPR, CAN-SPAM in the United States and CASL in Canada. You are the sender; we provide the tools.
You also may not:
- resell or rent out SplashSend, or let others use your account in return for payment;
- try to get into accounts, data or parts of the service that aren't yours, or test its security, without our written permission;
- copy or reverse engineer the service, except where the law allows it;
- scrape the service, or reach it by automated means other than our API;
- use SplashSend to build or test a product that competes with it.
You may not upload, collect or store card or bank account numbers, passport, driving licence or National Insurance numbers, or passwords, and you may not knowingly hold details of anyone under 16. If you collect special category data, such as health information, through a form, you must have a lawful basis for it, as our Data Processing Agreement explains.
We don't provide SplashSend for: multi-level marketing or recruitment schemes; get-rich-quick or work-from-home offers; payday loans, debt relief or credit repair; cryptocurrency; gambling or betting; selling or renting lists, or lead generation; emails mainly promoting other companies' products for affiliate commission; prescription medicines; adult content or escort services.
4. The shared sending domain
Unless you verify your own domain, your emails go out from our shared sending domain, whose reputation every customer on it shares. So we watch bounces, complaints and unsubscribes across the service, and we may slow down, pause or stop sending from an account whose mail is damaging that reputation, with or without notice, until it is resolved. Verifying your own domain under Setup takes you off the shared domain and is free on every plan.
5. Plans, limits and payment
Each plan includes a maximum number of people on your list; the free plan also limits sends per month. Current plans and limits are on our pricing page. When you reach a limit the service tells you and stops the thing that would exceed it, such as adding more people or sending more email that month, until you upgrade or make room.
Unlimited sends means we never charge you per email. If an account regularly sends more than 30 emails a month for each person on its list, we'll get in touch first, and we may slow or pause its sending until we agree a plan that suits that volume.
Each business may have one free account. Opening more, or splitting a list across accounts to stay within the free plan's limits, counts as getting around them.
There is no fixed limit on storage, but it is for your email marketing: your people and their details, your designs and pictures, your forms and the data your emails use. You may not use SplashSend as general file storage or to host pictures or files for use elsewhere. If an account holds far more than a business of its size needs, we'll get in touch and ask you to reduce it or move to a plan that suits it. If nothing changes within 30 days, we may limit what the account can add.
Our API has rate limits, set out in its documentation, and we may change them. We may suspend an API key that is used to break these terms or that puts the service at risk.
Paid plans are billed monthly in advance through Stripe, or through Shopify if you installed SplashSend from the Shopify App Store, in which case Shopify's billing terms govern payment. Prices are shown before you subscribe, and we give at least 30 days' notice of a price change. If a payment fails we will retry and let you know; if it keeps failing we may move your account to the free plan.
You can cancel at any time and your plan stays active until the end of the period you have paid for. We do not refund partial months, except where the law requires it.
6. Your content and your data
Everything you upload or create stays yours. You give us the licence we need to store it, send it and show it back to you, and nothing more. You are responsible for what you send, for having the rights to it, and for having the consent you need from the people you send it to.
We process the details of the people on your list only on your instructions, as set out in the Data Processing Agreement. Our Privacy Policy explains what we do with data about you.
7. Writing and design help, and Cruise
Parts of SplashSend use AI models to write, design and review emails, and Cruise can write and send emails on a schedule. The output is generated by a model, can be wrong, and is yours to check. You are responsible for everything sent from your account, including emails Cruise wrote, whether or not you read them first. Cruise's "Ask me first" setting holds every email for your approval if you want to read each one. We make no promise about what a model will produce, and we do not use your content to train any model.
8. Availability and support
We work to keep SplashSend running but do not promise it will never be interrupted. We may change or withdraw features, and we will tell you in advance where a change removes something you rely on. Support is by email and in the app.
9. Ending the agreement
You can close your account at any time under Setup. It is scheduled for deletion 30 days later, you can restore it during those 30 days, and after that everything in it is permanently deleted and cannot be recovered. Export your list first if you want to keep it.
We may suspend or close your account without notice if you break section 3 or 4, if the law requires it, or if your account is used in a way that puts the service or other customers at risk. We may also close an account that has gone quiet: after a year with no sign-in, no emails sent and nobody new joining the list (or 90 days if the list is empty) we email a warning, then 30 days later schedule closure, then delete the account 30 days after that. Signing in at any point stops this.
We may also close an account for any other reason by emailing you at least 30 days before we do. If you're on a paid plan, we'll refund what you paid for the time after it closes.
When we close an account, everything in it is deleted 30 days later. Until then you can ask us for a copy of your list, unless we closed the account for abuse or the law stops us.
Suspending an account for breaking these terms doesn't pause or refund its plan.
We may review how an account is used, including the emails it sends and the data it holds, to check it follows these terms. We may also ask you to show who you are, your business or how you got your list, and hold sending until you do. We may report illegal activity to the authorities.
10. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law says cannot be limited.
Otherwise, we are not liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill, and our total liability to you in any 12-month period is limited to the amount you paid us in that period, or £100 if you paid nothing. The service is provided as it is; we do not promise that it will meet every need or be free of errors.
11. Your responsibility to us
You will cover any loss, claim or cost we face because of what you send through SplashSend, the lists you upload, or a breach of these terms, including a claim that you emailed someone without the consent the law required.
12. General
We may update these terms; the date at the top changes when we do, and we let account holders know by email about material changes before they take effect. Continuing to use the service after that means you accept them. If part of these terms is found unenforceable the rest still stands. You may not transfer your account to someone else without asking us; we may transfer this agreement to a business that takes over SplashSend. We are not responsible for delays caused by things outside our reasonable control. These terms, with the policies they refer to, are the whole agreement between us about the service.
13. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
